Are voters required to wear masks when voting in person?
Yesterday (October 28), we informed our members that a federal
district judge out of San Antonio issued an opinion voiding and invalidating an exemption
to Governor Abbott’s statewide mask mandate for “any person who is voting,
assisting a voter, serving as a poll watcher, or actively administering an
election… .” Perhaps not surprisingly, later in the day the Fifth Circuit
Court of Appeals granted the governor and secretary of state’s request to
“stay” the federal judge’s opinion, effectively blocking the lower court’s
determination.
All of this means we are right back to where we started
regarding masks at the polls, presumably for the duration of the November
voting cycle. The governor’s statewide mask mandate, GA-29, does not require voters and other election
administrators to wear masks at a polling place, though doing so is strongly
encouraged.
